Victim was murdered in the above case. DNA samples taken from the body post mortem.

Certainly.

If the victim is alive both can be arrested for the crime. And the mitochondrial DNA of the son will show the difference with the fathers DNA profile. Provided, that the DNA samples should be procured in a better manner and processed without any contamination and all the necessary requirements must be followed.
